Civil Code Section 1984

Effective January 1st 2007; California Civil Code Section 1946.1 requires a property owner / manager to serve a written 60-Day "Termination of Tenancy"  notice to month-to-month tenants who have lived in the premises for one year or more.

Upon completion of the eviction process;
Civil Code Section 1984 provides for  a landlord or property mgr. to deliver a "Notice of Right to Reclaim Abandoned Property "to a tenant who leaves furniture or other personal property  behind. This notice gives a tenant 18 days to reclaim said property.  The landlord / property mgr. may  remove the items to a (local) secure location that is within reasonable distance from where the property is siezed.

If the property is valued less than $300, and after the 18 day time periods, a landlord/property mgr. can dispose of the property. If the value is more than $300, a landlord/property mgr. must hold a public auction. The auction
must be advertised in a local paper. In addition the auction must be held in a reasonabe proximity of the evicted residence.

The  landlord / property mgr. can deduct reasonable costs for storage and sales fees. The landlord / property mgr. then deposits the net proceeds with the local county's Revenue Department .
